Terms of Service

1. Acceptance of Terms

By accessing or using TurfAxis ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the Platform.

These Terms apply to all users of TurfAxis, including business operators ("Operators") who manage exterior service companies on the Platform, and their end clients ("Clients") who receive services and communications through the Platform.

TurfAxis is a product of Fixico Lawn Care LLC, an Oklahoma limited liability company. "TurfAxis" is a DBA (doing business as) of Fixico Lawn Care LLC.

2. Description of Service

TurfAxis is a multi-tenant field service management software platform designed for exterior service businesses. The Platform provides:

• Client and property management tools
• AI-powered service estimation and property measurement
• Job scheduling, routing, and field technician management
• Invoicing, payment processing, and financial tracking
• SMS and email client communications via Twilio
• Chemical application logging and compliance tracking
• Client-facing portals for estimate approval, invoice payment, and service management
• Onboarding, bookkeeping, and business intelligence tools

TurfAxis is currently in pre-launch development. Features and availability are subject to change. We will notify registered users of material changes.

3. Accounts and Eligibility

To use TurfAxis as an Operator, you must:

• Be at least 18 years of age
• Be a legal entity or individual operating a legitimate exterior service business
• Provide accurate and complete registration information
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access to your account.

One Operator account is permitted per business entity. Multi-location businesses may operate multiple locations under a single account.

4. SMS Communications and Consent

Operator Responsibilities for SMS

Operators who use the TurfAxis SMS features must:

• Only send SMS communications to clients who have explicitly opted in through the TurfAxis prospect portal consent form
• Honor all opt-out requests immediately — any client who replies STOP must receive no further messages
• Use SMS communications only for transactional purposes related to services the client has requested or is receiving
• Not use the TurfAxis SMS platform for marketing, promotional, or unsolicited communications
• Comply with all applicable telecommunications regulations, including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC requirements

SMS Opt-In Process

Client SMS consent is collected through an explicit opt-in checkbox on the TurfAxis prospect portal. The checkbox is unchecked by default and requires active selection before any SMS messages are sent. The consent language reads:

"I agree to receive SMS notifications about my service estimates, appointment confirmations, job completion notices, and invoices from [Service Provider Name]. Message and data rates may apply. Reply STOP to opt out at any time."

Opt-Out

Any client may opt out of SMS at any time by replying STOP to any message. Opt-out requests are processed immediately and automatically via Twilio. Clients may also update preferences in their client portal.

Message and Data Rates

Message and data rates may apply to SMS messages. Recipients are responsible for any charges from their mobile carrier.

5. Payments and Fees

TurfAxis subscription fees and billing terms will be published prior to platform launch. Payment processing for Operators' client-facing transactions is handled via Stripe Connect.

Operators are responsible for all fees associated with their Stripe Connect account, including processing fees charged by Stripe.

TurfAxis does not store payment card numbers or banking credentials. All payment data is processed and secured by Stripe, Inc. in accordance with PCI-DSS standards.

Refunds for TurfAxis subscription fees are evaluated on a case-by-case basis. Client refunds within an Operator's TurfAxis account are managed by the Operator and processed through their Stripe Connect account.

6. Data and Privacy

Your use of TurfAxis is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Operators retain ownership of their client and business data stored in TurfAxis. TurfAxis processes this data on your behalf as a data processor.

TurfAxis uses row-level security (RLS) to ensure that each Operator's data is isolated — no Operator can access another Operator's data.

Upon account termination, Operators may request an export of their data within 30 days of termination. After 30 days, data may be permanently deleted.

7. Acceptable Use

You agree not to use TurfAxis to:

• Send unsolicited, spam, or non-transactional SMS or email communications
• Violate any applicable law, regulation, or third-party rights
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Reverse engineer, decompile, or copy any part of the Platform
• Use the Platform in any way that could damage, disable, or impair its operation
• Misrepresent your identity or business to clients, or use the Platform to defraud clients
• Violate chemical application regulations, licensing requirements, or any applicable environmental law

Violation of these terms may result in immediate account suspension or termination.

8. Intellectual Property

TurfAxis, including all software, design, content, trademarks, and technology, is owned by Fixico Lawn Care LLC and is protected by applicable intellectual property laws.

Your use of TurfAxis does not grant you any ownership interest in the Platform. You may not copy, reproduce, distribute, or create derivative works from any part of TurfAxis without our express written permission.

You retain ownership of all data, content, and business information you input into TurfAxis.

9. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Fixico Lawn Care LLC's liability for any claim arising from your use of TurfAxis is limited to the amount you paid for the Platform in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Chemical Application Disclaimer

TurfAxis provides chemical application logging and compliance assistance tools as a convenience. These tools do not substitute for proper training, licensing, and label compliance. TurfAxis is not liable for any regulatory violations, property damage, or personal injury resulting from chemical applications performed by Platform users. Operators are solely responsible for ensuring their chemical applications comply with all applicable label requirements, licensing laws, and environmental regulations.

10. Regulatory Compliance

Operators are solely responsible for ensuring their business operations comply with all applicable federal, state, and local laws, including:

• Pesticide applicator licensing requirements in their jurisdiction
• EPA and state label compliance for all chemical applications
• TCPA and A2P 10DLC compliance for SMS communications
• Business licensing, bonding, and insurance requirements
• Employee classification and labor law compliance

TurfAxis provides tools to support compliance (license tracking, application logs, rate gates) but does not guarantee regulatory compliance or provide legal advice.

11. Termination

You may terminate your TurfAxis account at any time by contacting us at hello@turfaxis.com.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment, with or without notice depending on the severity of the violation.

Upon termination, your access to the Platform will cease. Your data will be retained for 30 days to allow for export, after which it may be permanently deleted.

12. Governing Law

These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of TurfAxis shall be resolved in the courts of Tulsa County, Oklahoma. By using TurfAxis, you consent to the jurisdiction of these courts.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email or in-platform notification. The "Last Updated" date at the top of this page will reflect the most recent revision.

Your continued use of TurfAxis after updated Terms are posted constitutes acceptance of the updated Terms.
